Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Spekie mobile application and related services (collectively, the "Service") provided by Spekie ("we", "our", or "us"). By downloading, installing, or using Spekie, you agree to these Terms and our Privacy Policy.

If you are using Spekie on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Eligibility

You must be at least 13 years old to use Spekie (or 16 years old if you are located in the European Union or United Kingdom). By using Spekie, you represent and warrant that you meet these age requirements. If you are under 18, you must have your parent or legal guardian's consent to use the Service.

3. Account Registration

To access most features of Spekie, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your password confidential and not share it with others.
• Notify us immediately at hello@spekie.app if you suspect unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

4.1 What Spekie Provides

Spekie provides an AI-powered speech coaching service that allows users to record themselves speaking, receive automated analysis and feedback on their delivery, and track improvement over time. The feedback is generated by artificial intelligence and is intended for educational and self-improvement purposes only.

4.2 AI-Generated Feedback

All coaching feedback, scores, and analysis in Spekie are generated by AI models and should be treated as automated guidance rather than professional advice. Spekie does not provide certified coaching, therapy, medical, or educational services. AI-generated feedback may occasionally be inaccurate, incomplete, or not suitable for your specific context.

4.3 Service Availability

We aim to keep Spekie available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable if the Service is unavailable for any reason.

5. Subscriptions and Payments

5.1 Free Tier

Spekie offers a free tier with limited features, including up to 3 practice sessions per day. Free tier users have access to transcripts, score history, and progress charts.

5.2 Premium Subscription

Spekie Premium is available as a paid subscription offering unlimited sessions and full coach feedback breakdowns. Subscriptions are billed through the Apple App Store on a monthly or annual basis.

5.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel your subscription at any time through your Apple App Store account settings.

5.4 Refunds

All subscription purchases are processed by Apple and are subject to Apple's refund policies. We do not directly issue refunds for in-app purchases. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

5.5 Price Changes

We reserve the right to modify subscription pricing at any time. We will provide at least 30 days' notice of price changes via email or in-app notification. Continued use after the price change takes effect constitutes acceptance of the new pricing.

6. User Content

6.1 Your Recordings

You retain ownership of the audio recordings you create in Spekie. By using the Service, you grant us a limited, non-exclusive, royalty-free license to process your audio recordings and transcripts solely for the purpose of providing the Service to you (transcription, analysis, and feedback generation). We do not use your recordings to train AI models.

6.2 Acceptable Use

You agree not to use Spekie to record or submit content that:

• Is unlawful, harmful, threatening, abusive, harassing, or defamatory.
• Infringes on the intellectual property rights of others.
• Contains personal information of third parties without their consent.
• Attempts to interfere with or compromise the integrity or security of the Service.
• Is used for any commercial purpose without our prior written consent.

7. Intellectual Property

All rights in the Spekie application, including but not limited to the software, design, text, graphics, and AI models, are owned by or licensed to us. Nothing in these Terms grants you a right to use our trademarks, logos, or other brand elements.

You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract the source code of the app, unless permitted by applicable law.

8. Disclaimer of Warranties

Spekie is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Warranties that the Service will be uninterrupted, error-free, or free of viruses.
• Warranties regarding the accuracy, completeness, or reliability of AI-generated feedback.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Spekie and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of revenue, or loss of goodwill.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Spekie and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

11. Termination

You may stop using Spekie and delete your account at any time by contacting us at hello@spekie.app or through the app's account settings (when available).

We may suspend or terminate your access to Spekie at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or for any other legitimate reason. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to conflict of law principles. Any dispute arising from these Terms or your use of Spekie shall be subject to the exclusive jurisdiction of the courts located in Turkey.

If you are a consumer in the European Union, you may also have the right to bring a claim in the courts of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or in-app notification at least 14 days before the changes take effect. Your continued use of Spekie after the effective date constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using Spekie before the effective date.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spekie regarding your use of the Service and supersede any prior agreements or understandings.
